Development Application - Two (2) Multiple Dwellings at 151 Riverton Drive, Rossmoyne
Why you have received this letter
The City has received the abovementioned development (planning) application. An assessment of the development proposal found that it does not meet all of the deemed-to-comply (‘standard’) requirements of the Residential Design Codes Volume 1 Part B (‘R-Codes’) and the City’s Local Planning Policy LP.01 – Residential Development.
Prior to making a decision on the application, adjoining affected owners and occupiers have been invited to view the development plans and elevations, and make comment on the planning matters that affect their property.
Matters that we would like you to consider
We ask that you consider the following matter(s) and let us know whether you object to or support the development proposal.
1. Street Setback
The development proposes a Ground floor & upper floor setback of 1.5m to the Primary Street (Second Ave).
Under clause 5.1.2 C2.1 of the R-Codes the standard primary street back of 6m is applicable. A lesser setback may be considered by the City with regard to the following design principles of
clause 5.1.2 P2.1 & P2.2 of the R-Codes:
“Buildings set back from street boundaries an appropriate distance to ensure they:
• Contribute to, and are consistent with, an established streetscape;
• Provide adequate privacy and open space for dwellings;
• Accommodate site planning requirements such as parking, landscape and utilities; and
• Allow safety clearances for easements for essential service corridor.
Buildings mass and form that:
• uses design features to affect the size and scale of the building;
• uses appropriate minor projections that do not detract from the character of the streetscape;
• minimises the proportion of the façade at ground level taken up by building services, vehicle entries and parking supply, blank walls, servicing infrastructure access and meters and the like; and
• positively contributes to the prevailing or future development context and streetscape as outlined in the local planning framework.”
2.Building height
The proposed dwelling has a maximum wall height of 8.9m and roof height of 8.9m.
Clause 5.1.6 C6 and Table 3 of the R-Codes provides for a development with a concealed roof to have a standard maximum wall height of 7m and roof height of 8m.
The proposed building height maybe considered by the City with regard to the following design principles of clause 5.1.6 P6 of the R-Codes:
‘Building height that creates no adverse impact on the amenity of adjoining properties or the streetscape, including road reserves and public open space reserves; and where appropriate
maintains:
• adequate access to sunlight into buildings and
appurtenant open spaces;
• adequate daylight to major openings into
habitable rooms; and
• access to views of significance.’

How and when to submit your comments
Please submit your comments (in writing) to the City by 5pm on 2 May 2025. Where possible we ask that you submit your comments via email however your written comments may be submitted via one of the following contact methods:

How the City will make a decision on the development proposal
Following closure of this consultation period, a delegated (authorised) officer of the City will consider the abovementioned matter(s) with regard to the relevant design principle(s). As part of this process the City will also consider any comments from adjoining affected landowner(s).
Should the City issue a decision on the development application (approval or refusal), we will write to you again to address the matters you have raised.
In certain circumstances the application may be referred to the Council for consideration at one of its Council meetings. If this occurs, the City will send you a letter/email inviting you to this meeting.
