The Proposal

The City has received the above-mentioned development application, which is briefly outlined below:

Change of use to Holiday house

  • Holiday house means a single dwelling on one lot used to provide short term accommodation but does not include a bed and breakfast.

Business Activities

  • Maximum of 4 guests and 2 vehicles per booking, keys stored onsite.
  • Minimum stay is 3 days, maximum stay is 60 days.
  • Check-in from 3:00 PM via lock box; Check-out by 10:00 AM.
  • On-site parking will be via the designated bays, guests must park in the driveway; verge and street parking discouraged.

House rules:

  1. Quiet hours are from 11:00 PM to 7:00 AM.
  2. No parties, events or unapproved visitors allowed.
  3. Smoking, vaping, and e-cigarettes are prohibited.
  4. Pets are not permitted.
  5. Guests must dispose of waste correctly using the green (organic) and yellow (recycling) bins.
  6. Guests are responsible for any damages and must report incidents immediately.

Prior to making a decision on the application, adjoining affected owners and occupiers are invited to view the development plans and supporting reports (as applicable), and make comment on the planning matters that affect their property. Please refer to the attached management plan for further information.

  1. The land use

Table 3 – Zoning Table of the City’s Scheme lists a Holiday House use as a ‘D’ (discretionary) land use in Residential zone. In considering an application for development approval, the local government will have regard to matters detailed in the state government’s Planning and Development (Local Planning Schemes) Regulations 2015 (Regulations 2015). In this instance the relevant matters for consideration include, but may not be limited to:

  • The aims and provisions of the City of Canning Town Planning Scheme No. 42 (‘Scheme’) - specifically whether the proposed use meets the objectives of the Residential zone, as outlined in Table 2 of the City’s Scheme.
  • The compatibility of the development with its setting including the relationship of the development to development on adjoining or on other land in the locality including, but not limited to, the likely effect of the height, bulk, scale, orientation and appearance of the development.
  • The impact on the amenity of the locality. ‘Amenity’ is defined in Schedule 1 of the Regulations 2015, as: “... all those factors which combine to form the character of an area and include the present and likely future amenity;”. Common amenity considerations include, but are not limited to, car parking and traffic generation, noise or odour emissions, and visual aesthetics.

Please submit your comments (in writing) to the City by 5 pm on 8 May 2025. Where possible we ask that you submit your comments via email however your written comments may be submitted via one of the following contact methods:

How the City will make a decision on the development proposal

Following closure of this consultation period, a delegated (authorised) officer of the City will consider the abovementioned matter(s) with regard to the relevant matters for consideration. This includes consideration of any comments from adjoining affected landowner(s) and occupiers. Should the City issue a decision on the development application (approval or refusal), we will write to you again to explain how the matters you raised have been addressed.

In certain circumstances the application may be referred to the Council for consideration at one of its Council meetings. If this occurs, the City will send you a letter/email inviting you to this meeting.
