The City has received the abovementioned development application. An assessment of the development proposal found that it does not meet all of the deemed-to-comply (‘standard’) requirements the Residential Design Codes (‘R-Codes’) Volume 1.

Prior to making a decision on the application, adjoining affected owners have been invited to view the development plans and elevations, and make comment on the planning matters that affect their property.

Matters that we would like you to consider

We ask that you consider the following matter(s) and let us know whether you object to or support the development proposal.

Site works (fill or excavation) and retaining walls

The development proposes filling of the land and an associated retaining wall up to a height of 1m and length of 6.8m with a nil setback to the subject lot's rear (south) boundary.

Clause 5.3.7 C7.2 of the R-Codes provides for a retaining wall up to a height of 0.5m be located up to the lot boundary. Alternatively, under clause 5.3.7 C7.2 the proposed fill and / or retaining walls should be setback 1m from the side lot boundary.

The proposed fill and/or retaining wall height may be considered by the City with regard to the following design principles of clause 5.3.7 P7 of the R-Codes:

  • “Development that considers and responds to the natural features of the site and requires minimal excavation/fill.
  • Where excavation/fill is necessary, all finished levels respecting the natural ground level at the lot boundary of the site and as viewed from the street.
  • Retaining walls that result in land which can be effectively used for the benefit of residents and do not detrimentally affect adjoining properties and are designed, engineered and landscaped having due regard to clauses 5.4.1.”

How the City will make a decision on the development proposal

Following closure of this consultation period, a delegated (authorised) officer of the City will consider the abovementioned matter(s) with regard to the relevant design principle(s). As part of this process the City will also consider any comments from adjoining affected landowner(s).

Should the City issue a decision on the development application (approval or refusal), we will write to you again to address the matters you have raised.

In certain circumstances the application may be referred to the Council for consideration at one of its Council meetings. If this occurs, the City will send you a letter/email inviting you to this meeting.

For any comments on the proposal, please complete the survey below and outline your concerns or support on the proposal. Please be advised that the proposal is advertised only for a period of 14 days, with all submissions required to be provided by no later than 5pm on the 20th February 2025.
