The City has received the abovementioned development application at 23 Tribute Street, Shelley, which is briefly outlined below:
- The Demolition of the existing Medical Centre,
- The construction of a two storey Childcare Premises for up to 85 children and 15 staff.
- The development proposes two outdoor play areas in the following locations:
- The first outdoor play area is located at the groundfloor and is located adjacent to Tribute Street West, Monota Avenue and 25A Tribute Street West.
- The second outdoor play area is located at the 1st floor and is located adjacent to Shelley Primary School, Monota Avenue and 25A Tribute Street West.
- An undercroft car park which provides a total of 18 car parking spaces comprising of 10 staff spaces, seven (7) visitor/drop off spaces and one (1) ACROD space.
- Vehicle access to the proposed development is from Monota Avenue.
- The proposed development would be open to customers from 6:30am to 6:30pm Monday to Friday with the proposed outdoor play areas used from 7:00am to 6:00pm only.
The subject site is zoned “Mixed Use R40” under the City of Canning Local Planning Scheme No. 42 (LPS42). The proposed “Child Care Premises” land use is a Discretionary (D) use in the Mixed Use zone. A Discretionary use means the use is not permitted unless the City has exercised its discretion by granting development approval.
The City is seeking comments on the following variation to LPS42:
- The development proposes a total of 18 car parking spaces comprising of 10 staff spaces, seven (7) visitor/drop off spaces and one (1) ACROD/visitor space. Instead of a total of 24 car parking spaces comprising of 15 staff spaces, Nine (9) visitor/drop off spaces as required by Clause 4.10.1(a) of LPS42.
Prior to making a decision on the application, adjoining affected owners are invited to view the development plans and supporting reports and make comment on the planning matters that affect their property. The application has been lodged through the “Development Assessment Panel” (DAP) pathway which means the City will prepare recommendations on the proposal for consideration. Please note that the City will endeavour to advise any tenants at this property of the above proposal; however, it may not always be possible for us to contact them. This may be due to the site not having a physical post box or there being more than one tenant on the property. As the owner of the property the onus is on you to pass on this information to your tenants if it is likely that they will be impacted by the proposal.

How and when to submit your comments
Should you wish to provide any feedback on the proposal, please submit your comments (in writing) to the City by 5pm on Monday 4 November 2024. Your written comments may be submitted via one of the following contact methods:

How the City will make a decision on the development proposal
Following closure of this consultation period, a delegated (authorised) officer of the City will consider the abovementioned matter(s) and will consider any comments from adjoining affected landowner(s). The City will prepare its recommendations through a Responsible Authority Report (RAR) to the Development Assessment Panel (DAP) for determination.
Submitters will be notified of the date in which the proposal is expected to be considered by the Panel. The City’s recommendations and report will be published on the DAP’s website to view prior to the meeting commencing. If determined, the submitters will be notified of the decision and how the DAP/the City considered the comments raised.
