An assessment of the application by the City’s officers noted the following matter(s) requiring consideration:
- The ‘independent living complex’ use is a use not listed under the City’s Local Planning Scheme No. 42.
Prior to making a decision on the application, adjoining affected owners and occupiers are invited to view the development plans and supporting reports, and make comment on the planning matters that affect their property.

- The land use
With regard to the proposal, the WAPC Position Statement: Residential accommodation for ageing persons December 2020 is relevant. The position statement introduces a new land use type ‘independent living complex’ meaning:
“a development with self-contained, independent dwellings for aged or dependent persons together with communal amenities and facilities for residents and staff that are incidental and ancillary to the provision of such accommodation, but does not include a development which includes these features as a component of a residential aged care facility”.
This is currently a use not listed under Table 3 of the City’s Local Planning Scheme No. 42.

- Visiting the City’s offices located at 1317 Albany Highway, Cannington, between 8:15am and 5:00pm, Monday to Friday;
- Contacting the responsible City officer (using the contact officer details provided below) and requesting that the documents be emailed to you; or
- Downloading the documents from the City’s Your Say webpage https://www.yoursaycanning.com.au/
How and when to submit your comments
Please submit your comments (in writing) to the City by 5pm on 14 October 2022. Where possible we ask that you submit your comments via email however your written comments may be submitted via one of the following contact methods:
- Email your comments to the assessing officer via the details listed below. Please remember to include the reference number 105.0919 in the subject line, and your name and affected property address in the body of the email; or
- Mail the comment form to: City of Canning, Locked bag 80, WELSHPOOL WA 6986.
How the City will make a decision on the development proposal
Following closure of this consultation period, a delegated (authorised) officer of the City will consider the abovementioned matter(s) with regard to the relevant matters for consideration. This includes consideration of any comments from adjoining affected landowner(s) and occupiers.
Should the City issue a decision on the development application (approval or refusal), we will write to you again to explain how the matters you raised have been addressed.
In certain circumstances the application may be referred to the Council for consideration at one of its Council meetings. If this occurs, the City will send you a letter/email inviting you to this meeting.
