Proposed Scheme Amendment No 196 to Town Planning Scheme No 40

Public comment is currently being invited on Scheme Amendment No. 196 to City of Canning Town Planning Scheme No. 40.

Council resolved to adopt Scheme Amendment No. 196 on 21 April 2015. The Western Australian Planning Commission requested the City to modify and readvertise the amendment on 14 October 2016. The Amendment proposes to

  1. Amend Table 2 – Zone Objectives to delete “City Centre” and “City Centre Deferred” zones rows.
  2. Amend Table 2 – Zone Objectives by deleting the words “City Centre and City Centre Deferred zones” and replacing with “Canning City Centre” in the Highway Commercial objective.
  3. Amend Table 3 – Zoning Table by deleting the “City Centre” and “City Centre Deferred” columns and relocating the “Centre” column following the “General Industry” column and renumber the columns accordingly.
  4. Amend paragraph 4.10.5(a) to replace the words “City Centre and City Centre Deferred zones” with “Canning City Centre”.
  5. Amend paragraph 4.11.5(a) to replace the words “City Centre and City Centre Deferred zones” with “Canning City Centre”.
  6. Delete clause 4.14 and its dependent subclauses including Table 8, renumber subsequent clauses accordingly and update cross references as required.
  7. Delete the “Canning Regional Centre” definition from Part 6 subclause 6.1.1 and inserting a new definition for “Canning City Centre”.
  8. Delete the ‘Regional Centre’ definition from Part 6 subclause 6.1.1.
  9. Delete Additional Use 36 from Schedule D – Schedule of Additional or Prohibited Uses and the Town Planning Scheme No. 40 Map.
  10. Rezone and reclassifying the Canning City Centre area from ‘City Centre’, ‘City Centre Deferred’, ‘Mixed Business’, ‘Residential R17.5/R40’, ‘Residential R17.5/R60’ and Local Authority Reservation for ‘Civic & Cultural Areas’ to ‘Centre’, Local Authority Reservation for ‘Public Purposes’, Local Authority Reservation for ‘Civic & Cultural Areas’ and ‘Residential R60’ as shown on the Scheme Amendment No. 196 Map.
